hi all
just before christmas got a nokia n70 on O2 3G contract. during the deal talked at great lenghts with the sales person about making video calls to my partner and using the 3G network and services. also my partner already has a 3 3G phone.the sales person told me how they had made there first video call on the own nokia n70 on the O2 3G network only to discover over christmas that O2 3G isnt planned to be in the area i live in for another 3 months. went in to phones 4 u today and had a bit of an argument with the salesperson about how she could sell us the phone on a contract that wouldnt be of no use until march. asked about her so called video call which she said she had made that call in southampton about 30 miles away from where i live in poole. i did mention that maybe i should move to southampton.how do i stand with regards compensation or cancelling the contract as my 14 days period has passed and as she said in a rather blunt way that i would just have to wait till there is a O2 3G network in my area.
many thanks for any advice on this matter or from other people who have had similar problems.

Go above her head, keep complaining. You can get out of contracts if you try hard enough. When CDMA first came to Australia, I bought three handsets under contract from Telstra for my family because it was supposed to give them better coverage - long story short the coverage is crap and I got out of all three without paying a cent.

Ok, end of the day, as much as I hate Phones 4U, its not the salespersons fault.

Do you really think we ALL have this unbelieveable power to know EXACTLY how good coverage is in EVERY SINGLE area in the UK? Don't be daft, of course we don't.

So please, before you go any further, take a step back and take some consideration for that poor salesperson, she probably went away from that whole experience feeling really bad and like she'd done something wrong, when all she's done is sell you a phone like you asked.

You've got a 14 day cancelation period, so as long as you cancel it within 14 days your ok. After that point, they really don't have much of a legal obligation to let you cancel, as 2 weeks is more than ample amount of time to see if you have coverage or not. If its taken you more than two weeks to turn the phone on, try and make a video call and realise you can't, thats your fault to be blunt.

But, if your going to persist, call 3 Customer Services or possibly Phones 4U head office, dont keep bugging the sales staff and shouting at them if they've done nothing wrong! We are people with feelings too you know...

Cingular gives you 30 days to return if you don't like

I would keep nagging them till they let you. False information given and they didn't throughly explain to you the inner workings of the service. You can get away w/ this if you nag them.

Hmm, I didn't notice that this was after 14 days. What took you so long? Coverage is the reason why they give you the 14 days.

sounds like a cop out to me .. 14 days is indeed enough for you to realize there is no coverage... either live with it for now... or wait till march :)

i could understand if we had not talked about making video calls but she kept going on about how great it would be that I would be able to make video calls to my partner. at this point she was in a shop in poole where she works and must have known that there was no O2 3G in that area but failed to mention this to us thats what has annoyed me and as for the 14 days bought the phone on the 20th as a christmas present for my partner and after several attempts to make video calls with no sucess decided to go and check if there was a problem with the phone. not realising that there was no network coverage for the video calls. also went into the O2 shop and they knew straight away about the 3G network would have told us about there being no O2 3G in the area especially if the topic of making video calls was discussed during the sale. have emailed phones 4 u and will await there response.
